What innovations in the fight against money laundering?

The ratification of Directive (EU) 2018/843 of the European Parliament and of the Council of May 30, 2018 (5th directive), transposed into French law by ordinance n ° 2020-115 of February 12, 2020 is provided for by article 21 III of the bill on various adaptation provisions to EU law in economic and financial matters. Adopted at first reading by the Senate on July 8, 2020, it was tabled before the National Assembly on July 10, 2020 and referred to the Economic Affairs Commission which appointed Ms. Valéria Faure-Muntian, rapporteur.
This transposition comes as France will be subject to a new assessment by the FATF during the last quarter of 2020.
The transposition brings several changes:
- Widening of the field of professionals subject to the AML-FT system with the appearance of new players such as the CARPAS and the clerks of commercial courts in charge of the register of beneficial owners.
- Widening of the scope of activities subject to AML-FT obligations of legal professionals, art market players, etc.
- Modification of the scope and content of due diligence obligations
- Modification of reporting obligations
